ITS-EPA II transition

FAQs

We realize that during the transition of work from an incumbent to a new provider such as CGI leads to questions from current incumbent staff and partners. Below are some Frequently Asked Questions and Answers to those questions relative to CGI, working at CGI, and our plans under the new ITS-EPA II contract. If you have additional questions not covered here, please email Referrals@cgifederal.com. We'll update this section frequently with recurring questions and answers.

1. If I allow CGI to use my name in a proposal, will it get back to my current employer that I am engaging in discussions with you? New FAQ!
A: No, CGI will not disclose such information. Further, under the exemptions covered by the Freedom of Information Act (FOIA), this type of information is "privileged and confidential." Prior to award and until a proposal is incorporated in an awarded contract, exemption B3 under the FOIA protects our entire proposal (including resumes and names). Subsequent to award, exemption B4 protects commercial information that is "privileged and confidential." Should another firm be awarded, CGI's proposal would never be incorporated by definition and therefore remains under the protection of exemption B3 in perpetuity. As it states on the agency website, "it is the policy of the agency to make records available to the public to the greatest extent possible, in keeping with the spirit of the FOIA, while at the same time protecting sensitive information." More details about the FOIA can be found at: http://www.osec.doc.gov/omo/FOIA/exemptions.htm.
2. Isn’t it a conflict of interest for me to engage in discussions with CGI or to allow you or another firm to use my name and/or resume in a proposal since I currently work on the ITS EPA II contract? New FAQ!
A: No. Aside from terms of some contractual agreement, a conflict of interest (COI) here would only occur when a person is sharing or disclosing a company’s or client’s confidential and/or proprietary information. By signing a contingent offer letter with CGI or permitting CGI’s use of your name in a proposal, you will not be obligated to provide confidential or proprietary information to CGI (or any other firm); conversely, we would not provide any such information to you either. The mere signing of this agreement does not automatically create a COI. A conflict in the form of a breach of contract or violation of company policy might exist if you have entered into a signed agreement with your current employer or violated a communicated company policy that limits your ability to work for CGI or any other employer supporting the ITS EPA contract. In addition, higher level executives may have a duty of loyalty or may have signed restrictive covenant agreements that limit their post-termination employment opportunities.
3. Should I rely on this FAQ as the equivalent of legal advice? New FAQ!
A: No. Nothing in this FAQ should be considered legal advice.
4. Does CGI offer a Commuter Account? New FAQ!
